The undersigned Competitor agrees to abide by the rules of The Barbados Ninja Throwdown, including the completion of the above medical questionnaire.
The undersigned Competitor agrees that all use of The Barbados Ninja Throwdown’s facilities, equipment, services, training and programs shall be undertaken at his/her sole risk and The Barbados Ninja Throwdown shall not be liable for any injuries, accidents or deaths occurring to guest, arising either directly or indirectly out of utilizing The Barbados Ninja Throwdown’s facilities, equipment, services, training methods and programs. The Competitor for himself/herself and on behalf of his/her executors, administrators, heirs and assigns, does hereby expressly release, discharge, waive, relinquish all legal rights and causes of action against and covenants not to sue The Barbados Ninja Throwdown its officers and agents for all such claims, demands, injuries, damages or causes of action, with respect to use of The Barbados Ninja Throwdown’s facilities, equipment, services, training methods and programs.
The undersigned Competitor declares that they have completed the enclosed medical questionnaire as required by The Barbados Ninja Throwdown and that they are physically able to participate in intense physical activity. Furthermore, the Competitor declares that The Barbados Ninja Throwdown has advised the Competitor to obtain a medical clearance in the event they answer yes to any of the medical history questions, or if they are unsure of their physical health. If the Competitor maintains that he/she is physically capable of pursuing physical activity with The Barbados Ninja Throwdown without such steps being taken, then the Competitor does so entirely at his/her own risk.
The undersigned Competitor expressly agrees that this release, waiver, assumption of risk and indemnity agreement is intended to be as broad and inclusive as permitted by the Laws of Barbados and that if any portion thereof is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force and effect. The undersigned Competitor acknowledges that The Barbados Ninja Throwdown offers a service to the Competitor encompassing the entire recreational and/or fitness spectrum. The Barbados Ninja Throwdown nor its servants and/ or agents are not in the business of selling weightlifting equipment, exercise equipment, or other such products to the public, and the use of such items is incidental to the service provided by The Barbados Ninja Throwdown. This release is not intended as an attempt to release responsibility for gross negligence or intentional acts.
The Competitor acknowledges that by signing this waiver that his/her face will be used on all types of media(tv, internet and other promotional things).
The Competitor acknowledges that the conditions experienced during the Barbados Ninja Throwdown may vary for each participant, as this is an outdoor event. Weather and environmental factors can differ, impacting the course and overall experience. We appreciate your understanding and flexibility as we strive to provide a safe and enjoyable event for all participants under varying conditions. It could result that (an) athlete(s) get’s to (re) run the BNT Course on August 17 or August 18th at a designated time slot, that will be communicated promptly.
The Competitor acknowledges that he/she can test BNT Obstacles during Redemption Time at their own risk and abides by House Rules (https://barbadosninjathrowdown.com/faqs).
The Competitor acknowledges that he/she has carefully read this waiver and release and fully understands that it is a release of liability, express assumption of risk and indemnity agreement. The Competitor is aware and agrees that by executing this waiver and release, the Competitor is giving up his/her right to bring a legal action or assert a claim against The Barbados Ninja Throwdown and its servants and or agents for trainer’s negligence, or for any defective product used while receiving personal training. The Competitor has read and voluntarily signed the waiver and release and further agrees that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
